These Terms of Service (“Terms”) are a binding agreement between you and Thrive Homes, LLC (“Thrive Homes,” “we,” or “us”). By using our website, online portal, or any services that we provide, you agree to be bound by these Terms as well as our Privacy Policy. If you do not accept these Terms, you may not use our Services.

1. Services Provided

Thrive Homes provides home modification and renovation services that improve accessibility, including ADA-compliant upgrades. Our website and portal are tools for clients, Managed Care Organizations (MCOs), Medicaid, and subcontractors to request, schedule, and manage projects. While our process is clinically informed, Thrive Homes does not provide healthcare or medical advice, and nothing we offer should be taken as medical treatment.

2. Eligibility and User Responsibilities

The Services are intended for adults who can legally enter into agreements in their jurisdiction. By engaging with Thrive Homes, you confirm that the information you provide is accurate and that you are authorized to submit it. You agree that you will not misuse the website or portal, attempt to disrupt their function, or upload false or harmful content.

You are responsible for:

• Ensuring that all information you provide is truthful and complete.

• Updating your information when it changes.

• Keeping login details secure, if you are provided access to our portal.

3. Information We Collect and Use

In order to deliver our Services, Thrive Homes collects certain information. For clients, this includes names, addresses, contact details, and project-related materials such as photographs or home layouts. For MCO or insurance representatives, this includes contact information necessary for authorizations and billing. For subcontractors and vendors, this includes business and compliance documentation such as W-9 forms, licenses, and proof of insurance.

This information is used to communicate with you, coordinate projects, process billing, improve our operations, train our staff, and occasionally share updates or marketing information. More detail about how we handle data can be found in our Privacy Policy.

4. Sharing of Information

We only share information when it is required to provide Services, including:

• With MCOs, Medicaid, and insurance providers for authorizations and claims.

• With subcontractors and vendors engaged to complete renovation projects.

• With third-party providers who supply scheduling, accounting, or customer management systems.

We never sell or rent personal information to third parties.

5. Service Expectations and Limitations

We strive to complete every project in a timely and professional manner. However, you understand that delays may occur due to reasons beyond our control, such as weather, permitting, or supply chain issues. Thrive Homes is not liable for such delays.

We also rely on accurate information provided by clients, subcontractors, and MCOs. Thrive Homes cannot be held responsible for delays or errors that result from incomplete or incorrect information.

6. Intellectual Property

All materials on our website and portal, including branding, images, and software, are the property of Thrive Homes or are used with permission. You may not copy or redistribute these materials without written approval.

Any content you provide, such as photos or layouts, remains your property. However, by submitting it, you grant Thrive Homes a license to use it as needed to perform Services and improve our operations.

7. Payments

Billing for Services may be handled through Medicaid, MCOs, insurance providers, or direct pay arrangements. Subcontractors and vendors are paid under their agreements with Thrive Homes and not through the website or portal.

8. Limitation of Liability

To the maximum extent permitted by law, Thrive Homes is not liable for indirect or consequential damages arising from use of the Services. We are not responsible for delays beyond our control or for errors caused by third parties. Although we carefully manage our subcontractors, Thrive Homes is not liable for their independent actions except where required by law.

9. Governing Law

These Terms are governed by the laws of the State of Kansas. Any dispute must be resolved in the state or federal courts located in Kansas, and you agree to this jurisdiction.

10. Changes to the Terms

Thrive Homes may update these Terms at any time. Changes are effective immediately upon posting to our website. Your continued use of the Services after updates constitutes acceptance of the revised Terms.
